News Update: Fubara Made a Big Mistake According To Babatunde Ogala (SAN)
According to News media house, Senior Advocate of Nigeria, Babatunde Ogala, has weighed in on the political crisis in Rivers State, criticizing Governor Siminalayi Fubara for remarks made in the aftermath of the Supreme Court judgment.
Speaking on one of the news outle, Ogala argued that Fubara’s statement, “We will tell you what to do at the appropriate time,” was a significant misstep that contributed to escalating tensions in the state.
Ogala explained that given the fragile political climate, Fubara’s words could have been misinterpreted as a veiled threat or an endorsement of unlawful actions.
He emphasized that when a leader speaks during a period of unrest, every word matters, and caution must be exercised to prevent fueling further instability.
“In situations where there are threats of violence over political disputes, a responsible leader should immediately condemn such threats and urge supporters to remain peaceful,” Ogala stated. “Unfortunately, that did not happen at the time, which only heightened concerns.”
The legal expert also referenced the Supreme Court’s position on governance in Rivers State, noting that the court had described the governor’s actions as undemocratic.
According to Ogala, the court’s ruling highlighted irregularities in the state’s governance, including the breakdown of the legislative arm and the unilateral decisions made by the executive.
Tinubu declares state of emergency in Rivers; Suspends Fubara, Deputy and Others
Commenting on the federal government’s declaration of a state of emergency in Rivers State, Ogala asserted that President Tinubu acted within the constitutional provisions of Section 305.
He explained that under this law, the president has the authority to issue a proclamation first and then seek ratification from the National Assembly.
He dismissed claims that Tinubu’s decision was unconstitutional, arguing that the legal process allows for such measures when governance structures collapse.
